    Divorce | Contested/Uncontested
At Reed & Hickman, we understand how emotionally and financially challenging a divorce and other domestic matter can be. We are committed to providing affordable but quality legal assistance with a wide range of issues involving:

No-Fault / Uncontested Divorce

This type of divorce will typically proceed more quickly, be less complicated and less of a financial burden.
In most cases, the parties do not have to go to court when getting ready to finalize the divorce. Usually you can get divorced in 2 ½ to 3 months. 
In an NO FAULT”, irreconcilable differences or uncontested divorce, both partners agree on the divorce and grounds for divorce- irreconcilable differences.  They also agree on child custody, child support, child visitation and property division.  They do not require the court to divide property (assets), matters concerning children, etc.  No one is served papers in this type divorce- because you both agree upon the divorce.
The uncontested divorce requires a "cooling -off" period of 60 days. Meaning once the divorce is filed either party can change their mind and stop the divorce from going forward.
Often the attorney represents only one of the parties and the unrepresented parties acknowledges this fact and proceeds pro se or hires their own counsel.
Child support can be collected through a wage order if agreed upon by both parties in this type of divorce. This is not an automatic event, It is also important for the party that will receive the child support to understand that the attorney does not guarantee that the child support will be paid on time or at all. Additionaly, the non- custodial party is under no obligation to visit the child(ren) during scheduled visitation periods. A schedule is made, but it cannot enforce the non custodial parent actually show up and visit . 

Contested Divorce

Contested divorce is one in which the parties cannot agree on the terms and conditions necessary to end the  marital partnership. The husband and wife desire to dispute either child custody issues including child support and child visitation, division of property or the reason for the divorce.
In a contestant divorce the party seeking the divorce must be able to prove grounds in Court for the CHANCELLOR to grant the divorce decree. Proving the grounds is often effected through a corroborating witness(s) whose testimony in Court sustains the statutory grounds for the divorce. This is a court case that involves a trial; The parties must hire counsel and go before the Judge with their witnesses.
This type of divorce can take a long time. Often these divorces may take 1 to 2 years to prepare the case for trial.  The spouse is served papers that are the Complaint for Divorce. As Defendant, they have 30 days to respond with an answer to the Complaint and at that time they may make a counter-claim for divorce. There are other processes and procedures that often occur before trial such as depositions, discovery, exchange of mandatory financial disclosure documents. The attorneys for the husband and wife will attempt to resolve issues and terms of the divorce or the terms and issues of the case for trial. Sometimes you can expect to go to courts several times before the judge makes a final decision granting the divorce
Because of the time involved and the detailed trial preparation coupled with the emotional issues both parties may bring to the attorneys, this is a more costly legal matter.
It is not recommended that either party attempt to represent himself/herself in the court of law due to the complexities of this type of divorce
